Withdrawal of permitted development rights (Article 4 directions)
The withdrawal of permitted development rights by the Local Planning Authority.
Some projects and development can be undertaken without the need for planning permission. This is known as 'permitted development'.
In some instances, we (as the Local Planning Authority) may withdraw permitted development rights by issuing an 'Article 4' direction. An Article 4 direction is used to provide additional control over development in a particular location; for example, where the local amenity and wellbeing of an area would be threatened.
There are two types of Article 4 Direction:
- an immediate direction is where permitted development rights are withdrawn with immediate effect and are then confirmed by us following consultation
- a non-immediate direction is where permitted development rights are withdrawn following consultation and confirmation by us
Where an Article 4 direction is issued, development that would otherwise be classed as permitted development will require planning permission.
An Article 4 direction does not necessarily mean we will subsequently refuse planning permission for a proposal. It simply means that we are given the opportunity to fully assess each proposal on its own merits, having regard to the planning policies and guidance in force at the time.

Land Comprising The Homestead, Hollybush Lane, Burghfield Common:
The erection, construction, maintenance, improvement or alteration of a gate, fence, wall or other means of enclosure being the development comprised within Class A, Part 2 of Schedule 2 to the Order.

The carrying out on agricultural land having an area of more than one acre and comprised in an agricultural unit of building or engineering operations other than engineering operations to which paragraph 4 of class vi of schedule 1 to the town and country planning general development order 1977 (as amended) applies) requisite for the use of that land for the purposes of agriculture (other than the placing on land of structures not designed for those purposes or the provision and alteration of dwellings), being development comprised within paragraph 1 of class vi referred to in schedule 1 to the said order not being development comprised within any other class.

Fords Farm Estate:
Relating to the erection or construction of gates, fences, walls or other means of enclosure exceeding one metre in height beyond the forward most part of any dwelling or existing fence line being development included within class ii referred to in schedule i to the said order and not being development comprised within any other class.
Land at The Hollies, Streatley:
The use of the land for the purposes of motor car or motor cycle racing and the erection or placing of moveable structures on the land for the purposes of that use being development comprised within paragraph 2 of Class IV of the Town and Country General Development Order 1977 and not being development comprised within any other class.

The enlargement, improvement, or other alteration of windows or doors which form part of the front elevations of the dwellinghouses being developed comprised within Class I (1) Referred to in the first schedule of the Town and Country Planning (General Development) Order 1950 and not being comprised any other class.
